Μπαίνουν τα χρήματα κοινού τραπεζικού λογαριασμού στην κληρονομιά όταν πεθάνει ένας συνδικαιούχος;
Όχι πάντοτε. Η ΔΕΔ 2732/2026 έκρινε ότι καταθέσεις σε κοινό τραπεζικό λογαριασμό, στον οποίο είχε τεθεί ο όρος του ν. 5638/1932 ότι μετά τον θάνατο ενός δικαιούχου το υπόλοιπο περιέρχεται αυτοδικαίως στους επιζώντες συνδικαιούχους, δεν αποτελούσαν στη συγκεκριμένη περίπτωση μέρος της κληρονομιαίας περιουσίας. Η ΔΕΔ συνεκτίμησε επίσης ότι από τα τραπεζικά στοιχεία δεν προέκυψε πραγματική επαύξηση της περιουσίας του κληρονόμου. Έτσι ακύρωσε καταλογισμό φόρου κληρονομιάς συνολικού ύψους 46.026,39 ευρώ. Η κρίση, όμως, συνδέεται με τα συγκεκριμένα χαρακτηριστικά των λογαριασμών και τα αποδεικτικά στοιχεία της υπόθεσης.
Από καταλογισμό 46.026,39 ευρώ σε μηδενική φορολογική υποχρέωση. Η υπ’ αριθ. 2732/2026 απόφαση της Διεύθυνσης Επίλυσης Διαφορών εξετάζει ένα ζήτημα με ιδιαίτερα πρακτική σημασία: τι συμβαίνει όταν ο διαθέτης αφήνει με διαθήκη χρηματικά ποσά τα οποία, όπως αποδεικνύεται στη συνέχεια, βρίσκονταν σε κοινό τραπεζικό λογαριασμό με συνδικαιούχο;
Στη συγκεκριμένη υπόθεση, ο φορολογικός έλεγχος είχε καταλογίσει στον προσφεύγοντα διαφορά φόρου κληρονομιάς 30.684,26 ευρώ και πρόσθετο φόρο 15.342,13 ευρώ, δηλαδή συνολικά 46.026,39 ευρώ. Η ΔΕΔ, όμως, κατέληξε ότι η συγκεκριμένη κληρονομιαία επαύξηση δεν είχε στην πραγματικότητα συντελεστεί και ακύρωσε την πράξη προσδιορισμού φόρου.
Το κρίσιμο σημείο δεν ήταν απλώς ότι υπήρχε κοινός λογαριασμός. Ήταν το είδος του λογαριασμού, ο όρος που τον διείπε και το τι πραγματικά είχε συμβεί με τα χρήματα μετά τον θάνατο.
Η απόφαση εκδόθηκε στις 26 Ιουνίου 2026 από τη Διεύθυνση Επίλυσης Διαφορών.
Η αποβιώσασα είχε αφήσει ιδιόγραφη διαθήκη, με την οποία προβλεπόταν, μεταξύ άλλων, η διάθεση του 1/2 των χρηματικών καταθέσεων που διατηρούσε σε συγκεκριμένη τράπεζα. Μετά την έκδοση κληρονομητηρίου υποβλήθηκε δήλωση φόρου κληρονομιάς, στην οποία δηλώθηκε ενεργητικό 132.489,06 ευρώ, δηλαδή το ήμισυ καταθέσεων συνολικού ύψους 265.578,62 ευρώ. Για τη δήλωση είχε αρχικά καταβληθεί φόρος 662,45 ευρώ.
Ο μεταγενέστερος φορολογικός έλεγχος έκρινε ότι η φορολογική μεταχείριση που είχε ακολουθηθεί ήταν εσφαλμένη. Θεώρησε ότι η δήλωση είχε υποβληθεί από φυσικό πρόσωπο και όχι από μη κερδοσκοπικό νομικό πρόσωπο και εφάρμοσε τις διατάξεις για κληρονόμους της Γ΄ κατηγορίας.
Το αποτέλεσμα ήταν βαρύ: διαφορά φόρου 30.684,26 ευρώ, πρόσθετος φόρος 15.342,13 ευρώ και συνολικός καταλογισμός 46.026,39 ευρώ.
Ο προσφεύγων, όμως, προέβαλε ένα ουσιωδώς διαφορετικό ζήτημα: ότι ουδέποτε έλαβε τα χρηματικά ποσά για τα οποία φορολογήθηκε, καθώς διαπιστώθηκε εκ των υστέρων ότι οι λογαριασμοί δεν ήταν ατομικοί αλλά κοινοί.
Η ύπαρξη μιας διαθήκης που αναφέρεται σε τραπεζικές καταθέσεις δεν αρκούσε από μόνη της για να απαντηθεί το φορολογικό ζήτημα.
Έπρεπε προηγουμένως να εξεταστεί αν τα συγκεκριμένα χρηματικά ποσά αποτελούσαν, κατά τον θάνατο, κληρονομιαία περιουσία που μπορούσε πράγματι να περιέλθει στον κληρονόμο.
Η τράπεζα είχε γνωστοποιήσει ότι κατά την ημερομηνία θανάτου δεν υπήρχαν ατομικά τραπεζικά προϊόντα στο όνομα της αποβιωσάσης. Παράλληλα, οι λογαριασμοί διέπονταν από όρο κατά τον οποίο, σε περίπτωση θανάτου ενός συνδικαιούχου, η κατάθεση και ο λογαριασμός περιέρχονταν αυτοδικαίως στους επιζώντες δικαιούχους.
Αυτό άλλαζε ουσιωδώς τη νομική εικόνα.
Η ίδια η απόφαση παραθέτει τις διατάξεις του ν. 5638/1932 περί κοινού λογαριασμού.
Κατά το άρθρο 1, κοινός λογαριασμός είναι εκείνος στον οποίο ένας ή περισσότεροι δικαιούχοι μπορούν να κάνουν χρήση του λογαριασμού χωρίς τη σύμπραξη των λοιπών. Το άρθρο 2 επιτρέπει να συμφωνηθεί επιπλέον ότι, όταν πεθάνει ένας δικαιούχος, η κατάθεση περιέρχεται αυτοδικαίως στους λοιπούς επιζώντες μέχρι τον τελευταίο.
Η ΔΕΔ παραπέμπει επίσης στην Ε.2015/01.04.2026 της ΑΑΔΕ και δέχεται ότι, όταν συντρέχει ο συγκεκριμένος όρος, το ποσό της κατάθεσης εξαιρείται από την κληρονομιά, αφού δεν αποτελεί μέρος της κληρονομιαίας περιουσίας.
Γι’ αυτό η ανάληψη από τον επιζώντα συνδικαιούχο χαρακτηρίζεται ως κτήση «ιδίω ονόματι» και «εξ ιδίου δικαίου».
Σε απλά ελληνικά: ο επιζών δεν αποκτά τα χρήματα επειδή έγινε κληρονόμος του αποθανόντος. Τα αποκτά λόγω του ίδιου του μηχανισμού του κοινού λογαριασμού και του πρόσθετου όρου που έχει συμφωνηθεί.
Η συγκεκριμένη υπόθεση αναδεικνύει μια κρίσιμη διάκριση.
Από τη μία πλευρά υπήρχε διαθήκη που αναφερόταν στο 1/2 των καταθέσεων. Από την άλλη, τα τραπεζικά προϊόντα αποδείχθηκε ότι ήταν κοινοί λογαριασμοί του ν. 5638/1932 με τον πρόσθετο όρο επιβίωσης.
Η απόφαση παραθέτει μάλιστα την ΑΠ 902/2019, σύμφωνα με την οποία, όταν έχει τεθεί ο όρος του άρθρου 2, η κατάθεση περιέρχεται στους επιζώντες συνδικαιούχους αυτοδικαίως και οι κληρονόμοι του αποθανόντος δεν υποκαθίστανται στη θέση του έναντι της τράπεζας.
Επομένως, για τη φορολογία δεν αρκούσε να εξεταστεί τι έγραφε η διαθήκη. Έπρεπε να διαπιστωθεί και ποια περιουσία μπορούσε πράγματι να αποτελέσει αντικείμενο κληρονομικής διαδοχής.
Η ΔΕΔ δεν έμεινε στη νομική θεωρία του κοινού λογαριασμού.
Στο πλαίσιο της ενδικοφανούς προσφυγής απευθύνθηκε στην τράπεζα και ζήτησε στοιχεία για τους λογαριασμούς, τους συνδικαιούχους, τα υπόλοιπα κατά τον θάνατο, τυχόν καταβολές προς τον προσφεύγοντα και την πορεία των λογαριασμών.
Από τα τραπεζικά στοιχεία προέκυψε, μεταξύ άλλων, ότι δεν είχε πραγματοποιηθεί μεταφορά στον προσφεύγοντα, ενώ αντίθετα εμφανίζονταν μεταφορές χρημάτων προς άλλον κληρονόμο και προς συνδικαιούχο, αναλήψεις από ΑΤΜ και ταμείο και συναλλαγές μέσω χρεωστικής κάρτας.
Αυτή η αποδεικτική εικόνα ήταν καθοριστική.
Το ερώτημα δεν ήταν πλέον απλώς «τι έπρεπε θεωρητικά να κληρονομήσει;», αλλά «αυξήθηκε πράγματι η περιουσία του κατά το ποσό για το οποίο φορολογήθηκε;»
Η απάντηση της ΔΕΔ ήταν αρνητική.
Ίσως το πιο ενδιαφέρον τμήμα της ΔΕΔ 2732/2026 υπερβαίνει το ειδικό ζήτημα του κοινού λογαριασμού.
Η απόφαση επισημαίνει ότι αντικείμενο της φορολογίας κληρονομιών και μέτρο της φοροδοτικής ικανότητας του κληρονόμου αποτελεί η επαύξηση της περιουσίας του με την κληρονομιαία περιουσία.
Παραπέμποντας στη νομολογία του Συμβουλίου της Επικρατείας που η ίδια μνημονεύει, τονίζει ότι η φορολογούμενη ύλη δεν επιτρέπεται να είναι πλασματική αλλά πρέπει να είναι πραγματική.
Και ακριβώς αυτή τη σκέψη εφαρμόζει στη συγκεκριμένη υπόθεση.
Η ΔΕΔ έκρινε ότι η θεωρούμενη από τον έλεγχο επαύξηση της περιουσίας του προσφεύγοντος ουδέποτε έλαβε χώρα. Αφενός, τα ποσά βρίσκονταν σε κοινούς λογαριασμούς με τον όρο του ν. 5638/1932 και εξαιρούνταν από την κληρονομιαία περιουσία. Αφετέρου, τα τραπεζικά δεδομένα έδειχναν ότι ο προσφεύγων δεν είχε λάβει τα χρήματα και ότι τα ποσά είχαν αναληφθεί και αναλωθεί από συνδικαιούχο.
Με άλλα λόγια, η φορολογία δεν μπορούσε να στηριχθεί σε μια περιουσιακή επαύξηση που υπήρχε μόνο ως υπόθεση αλλά όχι στην πραγματικότητα.
Η απόφαση προσθέτει μάλιστα ότι η αρχή της χρηστής διοίκησης επιβάλλει την αποφυγή ανεπιεικών και απλώς δογματικών ερμηνευτικών εκδοχών.
Το οικονομικό αποτέλεσμα της υπόθεσης αποτυπώνεται καθαρά στο διατακτικό:

Η ΔΕΔ έκανε δεκτή την ενδικοφανή προσφυγή και ακύρωσε την οριστική πράξη διορθωτικού προσδιορισμού φόρου κληρονομιάς.
Η απόφαση δεν σημαίνει ότι κάθε ποσό σε κάθε κοινό λογαριασμό αποκλείεται αυτομάτως από την κληρονομιά. Αναδεικνύει, όμως, ορισμένα κρίσιμα σημεία που πρέπει να ελέγχονται σε αντίστοιχες υποθέσεις:
Σε υπόθεση όπου υπάρχουν τραπεζικές καταθέσεις και περισσότεροι δικαιούχοι, η ίδια η δομή της ΔΕΔ 2732/2026 δείχνει ότι πρέπει να απαντηθούν τουλάχιστον τα εξής:
☐ Ο λογαριασμός ήταν ατομικός ή κοινός;
☐ Ποιοι εμφανίζονταν ως συνδικαιούχοι κατά την ημερομηνία θανάτου;
☐ Περιείχε η σύμβαση τον όρο του άρθρου 2 ν. 5638/1932;
☐ Ποιο ήταν το υπόλοιπο κατά τον χρόνο θανάτου;
☐ Ποιος τελικά ανέλαβε, μετέφερε ή χρησιμοποίησε τα χρήματα;
☐ Έχει ήδη υποβληθεί δήλωση φόρου κληρονομιάς ή εκδοθεί πράξη προσδιορισμού φόρου;
Η υπόθεση της ΔΕΔ δείχνει χαρακτηριστικά πόσο διαφορετικό μπορεί να είναι το φορολογικό αποτέλεσμα όταν η απάντηση στα ερωτήματα αυτά προκύψει από τα πραγματικά τραπεζικά δεδομένα.
Εξαρτάται από τα χαρακτηριστικά του λογαριασμού. Η ΔΕΔ 2732/2026 δέχθηκε ότι, όταν υπάρχει ο ειδικός όρος του ν. 5638/1932 περί αυτοδίκαιης περιέλευσης στους επιζώντες συνδικαιούχους, τα συγκεκριμένα ποσά δεν αποτελούν μέρος της κληρονομιαίας περιουσίας.
Στον λογαριασμό που εξετάστηκε από τη ΔΕΔ είχε συμφωνηθεί ότι μετά τον θάνατο ενός δικαιούχου η κατάθεση περιέρχεται αυτοδικαίως στους λοιπούς επιζώντες μέχρι τον τελευταίο.
Η ΔΕΔ παραθέτει τον κανόνα ότι οι καταθέσεις σε κοινούς λογαριασμούς με τον συγκεκριμένο όρο επιβίωσης δεν υπόκεινται σε φόρο κληρονομιάς για τους επιζώντες συνδικαιούχους, επειδή δεν αποτελούν κληρονομιαία περιουσία. Αυτό δεν πρέπει να γενικεύεται σε κάθε μορφή κοινού λογαριασμού.
Στην περίπτωση που εξετάζει η απόφαση, σημαίνει ότι μετά τον θάνατο ενός δικαιούχου η κατάθεση περιέρχεται αυτοδικαίως στους επιζώντες συνδικαιούχους μέχρι τον τελευταίο.
Η συγκεκριμένη απόφαση δείχνει ότι πρέπει να ελεγχθεί αν τα ποσά μπορούν πράγματι να αποτελέσουν κληρονομιαία περιουσία. Στην υπόθεση της ΔΕΔ, παρά την αναφορά της διαθήκης στις καταθέσεις, ο ειδικός όρος των κοινών λογαριασμών και τα τραπεζικά στοιχεία οδήγησαν σε διαφορετικό αποτέλεσμα.
Στη συγκεκριμένη υπόθεση είχε ιδιαίτερη σημασία. Η ΔΕΔ εξέτασε τις κινήσεις των λογαριασμών και διαπίστωσε ότι δεν είχε πραγματοποιηθεί μεταφορά στον προσφεύγοντα, ενώ είχαν πραγματοποιηθεί κινήσεις από άλλα πρόσωπα.
Η ΔΕΔ 2732/2026 αποτελεί συγκεκριμένο παράδειγμα αποδοχής ενδικοφανούς προσφυγής και ακύρωσης οριστικής πράξης διορθωτικού προσδιορισμού. Στην υπόθεση αυτή ο καταλογισμός των 46.026,39 ευρώ μηδενίστηκε.
Ότι δεν είχε υπάρξει πραγματική επαύξηση της περιουσίας του προσφεύγοντος με τα επίμαχα χρηματικά ποσά και, επομένως, δεν χωρούσε ο επίμαχος προσδιορισμός φόρου κληρονομιάς σε βάρος του.
Η ΔΕΔ 2732/2026 είναι ιδιαίτερα ενδιαφέρουσα όχι μόνο επειδή οδήγησε από καταλογισμό 46.026,39 ευρώ σε 0 ευρώ, αλλά κυρίως λόγω του τρόπου με τον οποίο προσεγγίζει το ζήτημα.
Για να κριθεί αν χρήματα τραπεζικού λογαριασμού αποτελούν φορολογητέα κληρονομιαία περιουσία, δεν αρκεί μια απομονωμένη ανάγνωση της διαθήκης ή της αρχικής δήλωσης φόρου. Στη συγκεκριμένη υπόθεση εξετάστηκαν η νομική μορφή των λογαριασμών, ο όρος του ν. 5638/1932, οι συνδικαιούχοι, οι απαντήσεις της τράπεζας και οι πραγματικές κινήσεις των χρημάτων.
Το σημαντικότερο, όμως, είναι η θέση ότι η φορολογούμενη ύλη πρέπει να αντανακλά πραγματική περιουσιακή επαύξηση. Όταν αυτή δεν έχει πράγματι συμβεί, η φορολογική επιβάρυνση δεν μπορεί να στηρίζεται απλώς σε μια θεωρητική εικόνα της κληρονομιαίας περιουσίας.
Κάθε περίπτωση απαιτεί έλεγχο των πραγματικών τραπεζικών δεδομένων και όχι μόνο της δήλωσης φόρου ή της διαθήκης. Η σύμβαση του λογαριασμού, η ύπαρξη του όρου επιβίωσης, οι συνδικαιούχοι, οι κινήσεις των χρημάτων και η ίδια η φορολογική πράξη μπορούν να μεταβάλουν καθοριστικά τη νομική αξιολόγηση.

Do funds held in a joint bank account form part of the estate when one of the account holders dies?
Not always. In Decision 2732/2026, the Greek Dispute Resolution Directorate (DED) held that deposits held in a joint bank account containing the survivorship clause provided for under Law 5638/1932 — whereby, upon the death of one account holder, the balance passes automatically to the surviving account holders — did not, in the specific circumstances of the case, form part of the deceased’s estate.
The DED also took into account that the banking evidence did not establish any actual increase in the heir’s assets. It therefore cancelled an inheritance tax assessment totalling €46,026.39.
The ruling, however, is closely linked to the specific legal characteristics of the accounts and the evidence available in the case.
From a €46,026.39 assessment to zero inheritance tax liability.
Decision 2732/2026 of the Greek Dispute Resolution Directorate examines an issue of significant practical importance: what happens when a testator leaves money by will, but the funds are later shown to have been held in a joint bank account with another account holder?
In this case, the tax audit had assessed against the appellant an inheritance tax difference of €30,684.26, together with an additional tax of €15,342.13, bringing the total assessment to €46,026.39.
The DED, however, concluded that the alleged inheritance-related increase in the appellant’s assets had never actually occurred and cancelled the tax assessment.
The decisive issue was not simply the existence of a joint account. What mattered was the legal structure of the account, the terms governing it and what had actually happened to the funds following the death of the account holder.
The decision was issued on 26 June 2026 by the Greek Dispute Resolution Directorate.
The deceased had left a handwritten will which provided, among other things, for the disposition of one half of the cash deposits she maintained with a particular bank.
Following the issuance of a certificate of inheritance, an inheritance tax return was filed declaring assets of €132,489.06, corresponding to one half of deposits totalling €265,578.62. Tax of €662.45 was initially calculated and paid.
A subsequent tax audit considered the tax treatment applied to be incorrect. It found that the return had been filed by a natural person rather than by a non-profit legal entity and therefore applied the provisions governing heirs falling within the third inheritance tax category.
The result was significant: an inheritance tax difference of €30,684.26, an additional tax of €15,342.13, and a total assessment of €46,026.39.
The appellant, however, raised a fundamentally different point: he had never received the funds on which he was being taxed, because it was subsequently established that the accounts were not individual accounts but joint accounts.
The mere existence of a will referring to bank deposits was not, by itself, sufficient to resolve the tax issue.
It first had to be established whether the relevant funds constituted estate assets at the time of death which could legally and effectively pass to the heir.
The bank confirmed that, at the date of death, there were no individual banking products held solely in the deceased’s name.
At the same time, the accounts were governed by a clause providing that, upon the death of one joint account holder, the deposit and the account would pass automatically to the surviving account holders.
That fact fundamentally changed the legal analysis.
The decision itself sets out the provisions of Greek Law 5638/1932 governing joint bank accounts.
Under Article 1, a joint account is one from which one or more account holders may make use of the funds without requiring the participation of the remaining holders.
Article 2 further permits the parties to agree that, upon the death of one account holder, the deposit will pass automatically to the surviving account holders until the last survivor.
The DED also refers to AADE Circular E.2015/01.04.2026 and accepts that, where such a clause applies, the deposit is excluded from the estate because it does not form part of the deceased’s inheritance assets.
This is why acquisition by the surviving account holder is described as occurring “in his or her own name” and “by virtue of his or her own right”, rather than by reason of inheritance.
Put simply, the surviving account holder does not acquire the money because he or she has become an heir of the deceased.
The funds are acquired by virtue of the legal mechanism governing the joint account and the survivorship clause agreed between the account holders.
The case highlights an important distinction.
On the one hand, there was a will referring to one half of the deposits.
On the other hand, the banking products were shown to be joint accounts governed by Law 5638/1932 and containing the additional survivorship clause.
The decision also refers to Greek Supreme Court Decision 902/2019, according to which, where the Article 2 clause applies, the deposit passes automatically to the surviving account holders and the heirs of the deceased do not step into the deceased’s position vis-à-vis the bank.
For tax purposes, therefore, it was not sufficient simply to examine what the will stated.
It was also necessary to determine which assets could legally and effectively form part of the inheritance.
The DED did not limit its analysis to the legal nature of the joint account.
During the administrative appeal proceedings, it contacted the bank and requested information regarding the accounts, the joint holders, the balances at the date of death, any payments made to the appellant and the subsequent operation of the accounts.
The banking records showed, among other things, that no transfer had been made to the appellant.
Instead, the records reflected transfers to another heir and to a joint account holder, ATM and counter withdrawals, as well as debit-card transactions.
This evidence proved decisive.
The question was no longer merely:
“What was the appellant theoretically entitled to inherit?”
It became:
“Did his assets actually increase by the amount on which inheritance tax had been assessed?”
The DED’s answer was no.
Perhaps the most significant aspect of DED Decision 2732/2026 goes beyond the specific issue of joint bank accounts.
The decision emphasises that the subject matter of inheritance taxation — and the measure of the heir’s ability to pay tax — is the actual increase in the heir’s assets resulting from the inheritance.
Referring to case law of the Greek Council of State cited within the decision itself, the DED stresses that taxable wealth cannot be fictitious or merely notional; it must be real.
It is precisely this principle that the DED applies to the case before it.
The Directorate held that the increase in the appellant’s assets assumed by the tax audit had never occurred.
First, the relevant sums were held in joint accounts containing the survivorship clause under Law 5638/1932 and were therefore excluded from the estate.
Second, the bank records showed that the appellant had not received the funds and that the sums had instead been withdrawn and spent by another joint account holder.
In other words, taxation could not be based on an increase in wealth that existed only as an assumption and not as an economic reality.
The decision further notes that the principle of good administration requires public authorities to exercise their powers in accordance with prevailing notions of fairness and to avoid unduly harsh or purely doctrinal interpretations.
The financial result of the case is clearly reflected in the operative part of the decision:

The DED upheld the administrative appeal and annulled the final corrective inheritance tax assessment.
The decision does not mean that every amount held in every joint bank account is automatically excluded from an estate.
It does, however, highlight several points that may be critical in similar cases:

☐ Who were the joint account holders at the date of death?
☐ Did the account agreement contain the Article 2 survivorship clause under Law 5638/1932?
☐ What was the account balance at the date of death?
☐ Who actually withdrew, transferred or used the funds?
☐ Has an inheritance tax return already been filed or has a tax assessment already been issued?
The case demonstrates how significantly the tax outcome may change once these questions are answered on the basis of the actual banking evidence.
It depends on the legal characteristics of the account.
DED Decision 2732/2026 accepted that where the specific survivorship clause under Law 5638/1932 applies, the relevant funds do not form part of the deceased’s estate.
In the account examined by the DED, it had been agreed that, upon the death of one holder, the deposit would pass automatically to the surviving account holders until the last survivor.
The DED refers to the rule that deposits held in joint accounts containing the specific survivorship clause are not subject to inheritance tax in the hands of the surviving account holders because the funds do not form part of the deceased’s estate.
This should not, however, be generalised to every type of joint account.
In the circumstances examined in the decision, it means that, upon the death of one account holder, the deposit passes automatically to the surviving joint holders until the last surviving holder.
The decision shows that it is necessary to determine whether the funds could legally form part of the estate in the first place.
In the case examined by the DED, despite the reference to the deposits in the will, the special terms governing the joint accounts and the banking evidence led to a different conclusion.
In this case, it mattered significantly.
The DED examined the account movements and established that no transfer had been made to the appellant, while transactions had instead been carried out by other persons.
DED Decision 2732/2026 is a specific example of an administrative appeal being upheld and a final corrective tax assessment being annulled.
In this case, the total assessment of €46,026.39 was reduced to zero.
The DED concluded that the appellant’s assets had not actually increased by the disputed amounts and that, as a result, the inheritance tax assessment could not stand.
DED Decision 2732/2026 is particularly noteworthy not only because it reduced an inheritance tax assessment from €46,026.39 to €0, but mainly because of the way it approaches the underlying legal and factual issues.
In determining whether funds held in a bank account constitute taxable inheritance assets, it is not sufficient to consider the will or the original inheritance tax return in isolation.
In this case, the DED examined the legal structure of the accounts, the survivorship clause under Law 5638/1932, the identity of the joint account holders, the bank’s responses and the actual movement of the funds.
Most importantly, the decision adopts the position that the taxable base must reflect an actual increase in the heir’s assets.
Where no such increase has in fact occurred, the tax burden cannot be based solely on a theoretical depiction of the estate.
Each case requires an examination of the actual banking evidence, not merely the inheritance tax return or the wording of the will.
The account agreement, the existence of a survivorship clause, the identity of the joint account holders, the movement of the funds and the tax assessment itself may fundamentally affect the legal analysis.
